Recent developments.


Recent case law of interest to real property owners

Brown v. Montage at Mission Hills, Inc. (August 20, 2021). The Court of Appeal held that a common interest development's ban on short term rentals does not apply to owners who purchased their properties prior to enactment of the ban.

Estate of Wall (August 24, 2021). The Court of appeal reaffirmed the community property presumption of Family Code 760 prevails over title only in actions between spouses, but after death the title presumption applies. However, the court also held the undue influence presumption prevails over title in post-death disputes calling into question the requirements to ensure property acquired with separate property funds and titled in the name of only one spouse remains separate property.

Gonzalez v. Mathis ( August 26, 2021). The California Supreme Court held a landowner is not liable to an independent contractor for injuries suffered due to known but unavoidable hazards. Here, a contractor fell of a roof where the conditions were known and hazardous and the court found the landowner not liable.
